Software developed, owned, sold or distributed by MindMaster.TV (hereafter "software") is protected by copyright law and international treaties. Unauthorized duplication may result in severe criminal and civil penalties and will be prosecuted to the maximum extent of the law. You agree not to resell or redistribute software without written permission.
Information and software available on this website is intended for personal development and educational purposes only. Use of the software to attempt to influence another person's thoughts or behavior without their knowledge is a violation of our licensing agreement and terms of use. MindMaster Software may only be installed on a computer for which you are the primary user and/or owner.
The information provided on this website should not be considered a replacement for the expert advice of a qualified health practitioner. Statements have not been evaluated by the Food and Drug Administration. This product is for personal development uses only and is not intended to diagnose, treat, cure or prevent any disease.
You agree that your use of software will be limited to self improvement and educational purposes only. You further agree that 1) software use will be in compliance with all local, state, and federal laws, 2) you will not use software to attempt to influence another person’s thoughts or behavior, or for any other illegal or malicious purpose, 3) you will only install the software on a computer for which you are the primary user or owner, 4) any other person that uses a computer on which software is installed will be notified of software installation. You agree to consult an attorney if you are unaware of all relevant issues and requirements.
The developers, owners, and distributors (hereafter "owners") of this software are not liable for any violations by you, or losses incurred by you as a result of using the software. You agree to indemnify, defend and hold the owner of this program harmless from and against any and all claims, damages, losses, costs, attorneys' fees, or other expenses.
Under no circumstances shall owners of software be liable for direct, indirect, special, incidental, or consequential damages resulting from the use, misuse, or inability to use this software, including without limitation, lost revenues or lost profits, even if owner has been advised of the possibility of such damages. You are solely responsible for adequate protection and backup of the data and equipment used in connection with this software.
You agree to indemnify, defend and hold the owners of this software harmless from and against any and all claims, liability, loss, damage or expense, including reasonable attorney's fees, arising from, or in any way related to, your use of this software.
Refunds: The money-back guarantee does not apply to free trial users or MP3 purchases. All MP3 purchases are final. Free trial users may cancel during the 14-day trial. Once free trial users are charged no refunds will be given.
Option 1 (MindMaster free trial users) can cancel their order by deactivating the software during the trial period (before they are automatically billed) and providing MindMaster Customer Service with the deactivation code they receive
Refunds or Cancellations without a deactivation code will not be issued. We reserve the right to charge a fee if the user requires a second activation key after one year.
Controlling Law/Enforcement: Arbitration: Any controversy or claim arising out of or relating to any provisions of this Agreement or the breech hereof, unless resolved by mutual agreement of the parties, will be finally settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association in effect as of the date of the Agreement by a single arbitrator appointed in accordance with said Rules, provided that the parties will be entitled to conduct discovery with respect to such controversy or claim in accordance with the California Code of Civil Procedure for a period determined to be reasonable by such arbitrator, and any disputes about discovery will be determined by the arbitrator. The arbitration determination of the arbitrator will be final and binding upon the parties to the arbitration and judgment upon the award rendered by the arbitrator will be entered in Solano County, California: Superior or Municipal Court, as appropriate. The place of arbitration will be Solano County, California. You agree that your dispute will not be heard by a jury and may not be made part of a class action lawsuit
